Purchase Information to Data Subjects
(in accordance to article 13 of the Legislative Decree n. 196/2003, Personal Data Protection Code)
Introduction
With this communication Linkem spa (further referred to only as Linkem) with the legal office in Milan in Via Pietro Mascagni 14, and the operating office in Rome in Viale Città d'Europa 681, integrating the information provided at the act of your registration in this company's Customer List, in fulfillment of its disclosure obligations as data controller of the processing of personal data supplied during the compilation of the present purchase order, intends to give You information about the purposes and the modalities of the processing; the obligatory or voluntary nature of providing your personal data; the subjects to whom the data could be communicated, as well as the rights that you can exercise.
Purposes of the Processing
The processing of the personal data requested by Linkem with the present form is carried out for the following purposes:
a) execution of the purchase order and connected invoicing;
b) allocation of the service and execution of further obligations taken on by Linkem due to the purchase contract of the card chosen by You;
c) fulfillment of the obligations set out in the Decree of the Ministry of the Interiors of 16 August 2005 and of the Related Text of the Law Decree 27 July 2005, n. 144 (also called Decreti Pisanu);
d) market analysis and market research.
Obligatory and/or voluntary nature of the providing of the Personal Data The providing of the personal data requested by the present order form is obligatory with respect to the purposes of points: a) being their processing necessary for the execution of the purchase order contained therein, b) being their processing by Linkem necessary for the allocation of the service and the execution of further obligations as required by the purchase contract of the card chosen by You, c) being their management necessary as foreseen by a law enforced provision. The lack to provide the data required with the present order form for the purposes mentioned in points a), b) and c) therefore hinders Linkem from supplying the service, from carrying out further obligations taken on with respect to the Client , and in following through with the purchase contract of the card chosen by the Client amongst those available.
However, the providing of the personal data for the purposes explained in point d) is voluntary, and therefore the lack of agreement to the relative data processing, does not involve any consequence for the user.
Modalities of the processing
Linkem carries out the management of personal data provided by means of the compilation of the present order form through both automated and not automated means. In particular, data, recorded and stored, remains accessible only to authorized Linkem personnel, and are protected from risk of destruction, modification, cancellation and unauthorized access.
Assigned I.T., sales and accounting personnel will be made aware of the personal data collected through the present form in reference to the purposes that points a), b) and c) refer to. In the case in which the Client consents to the processing as referred to in point d), the personal data acquired with the present form will be made aware to the marketing and client service personnel.
Communication of Personal Data
The area of interest of the communication of data gathered with the present order form will be primarily national, as Linkem supplies its service mostly in the national territory; it may also be international in relation to the location where the Client chooses to utilize the Service, and in that case, if the service itself is therein available.
Data Subject's Rights
The subject to whom the personal data transferred by filling in the present order form (data subject) shall be able at any time to exercise the rights and the powers recognized to him according to sections 7 and 8 of the d.lgs. 196/2003, namely:
A) the right to obtain, through the Client relationship service (info@linkem.com), without delay: 1) confirmation as to whether or not personal data concerning him/her exists, regardless of their being already recorded and communication of such data in an intelligible form; 2) indication of the source of the personal data, of the purposes and methods of the processing, of the logic applied to the processing, if the latter is carried out with the help of electronic means; 3) information of the identification data concerning the data controller and the data responsible, if any; 4) indication of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State's territory, data processor(s) or person(s) in charge of the processing; 5) the updating, rectification or, where interested therein, integration of the data; 6) the erasure, anonymization, or blocking of data that has been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed; 7) the certification to the effect that the operations as per numbers 5) and 6) have been notified, as also related to their contents, to the entities to whom or which the data was communicated or disseminated, unless this requirement proves impossible or involves a distinctly disproportionate effort compared with the right that has to be protected.
The rights referred to in numbers 1, 2, 3 and 4 may be exercised by making a request to the data controller or processor, without formalities, to the Linkem's Client Services department. Such a request may be renewed at intervals of no less than 90 days, unless there are well-grounded reasons;
B) the right to object, in whole or in part, on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
C) the right to object, in whole or in part, to the processing of personal data concerning him/her, where it is carried out for the purposes of commercial information, of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys .
DECLARATION OF CONSENT
The Client, having received the above mentioned information and therefore having a complete and full knowledge of the processing of the personal data conferred to Linkem s.p.a. agrees to the processing of the personal data for the purposes therein referred to in letters a), b) and c).
In addition, the undersigned, with respect to the processing of the personal data conferred, as referred to in letter d) - processing with the purposes of market research and analysis -, allows does not allow authorization.
